Juvenile delinquency is one of the most important and serious issue in today’s rapidly growing world.
Large numbers of people migrate from rural areas to cities we can notice this in commonly developing countries.
What we actually mean by juvenile delinquency?
Abnormal or antisocial behaviour of a child who is under the age of 18 is known as juvenile & delinquency are the minor crime, especially that is committed by young children
Juvenile delinquency can include crimes ranging from disorderly conduct, minor theft, and vandalism, to car theft, burglary, assault, rape, and murder etc .
Why is this happening?
In the world where technology , people , education , population is growing on the other hand the crime rate is also increasing due to the social negligence.
A minor can never think about doing a crime unless and until he/she saw it or badly influenced on it or forced by someone else.
For the full and harmonious development, of their personality, children should grow up in a family environment, in an atmosphere of happiness, love and understanding. The family has more influence when the child is young, as the child reaches adolescence, the peer group becomes increasingly important as an influence on behaviour.
Children learn basic concepts about good and bad from their family, they make their values and set the norms of society. Thus a family is a socialization school for the children. Parents and siblings have a great role in shaping the personality of the child.
The disintegration of joint families, broken families, single-parent families, separated families, frequent parents fight, lack of trust and confidence among the parents, criminal parents, psychological problems in parents, siblings rivalry, or unequal treatment between children may become reasons behind juvenile delinquency.
Psychological problems like depression, frustration, aggression, or hyper behaviour in parents or siblings can result in juvenile delinquency. In such a case, the child feels deprived and inferior among friends. There is a chance that children may adopt depression and anger from parents or elder siblings. Thus psychological problems in the family may result in juvenile delinquency.
Aims of Juvenile Justice
• It is based on the rights of the child.
• It applies the principle of restorative justice i.e. to restore the balance of a situation disturbed by crime rather than simply meting out punishment.
• This system puts the best interest of the child first.
• The primary objective of this system is to focus on the prevention of crimes and injustice done to juveniles.
Recent case report :
An eight year-old girl was allegedly raped by a nine-year-old boy under Sushant Golf City police station.
A case has been registered and the minor girl has been sent to the hospital for medical examination," said SHO Atul Kumar Srivastav. "The boy is awaiting an audience with the child welfare committee under the ministry of women and child development.
The police said that the girl begs at signals of Arjunganj near PGI while the boy lives near Sushant Golf City area and sells balloons on streets. Both happen to know each other and on Tuesday night they had come to a fair organised in the area. Later, the boy took the girl to a jungle behind Ekana stadium and allegedly raped her," the SHO added.
"The girl informed her father who then filed a complaint at the police station. The accused ran away after the incident, but has been identified," said Police.
Legal provision: According to section 83 of the Indian Penal Code, any child aged between 7 and 12 who commits an act of offence will be granted qualified immunity, depending on the mental ability of the child.
Conclusion:
Juvenile delinquency is a way for minors to get involved in adult crime since a large percentage of criminal activity has its roots in childhood and causes major problems around the world.
Murder, rape, burglary, kidnapping are a few other additions to them. based on available statistics, the perception that this crime is on the rise is not to be underestimated. In India previously Juvenile delinquency was not a great issue. It is said that the juvenile laws were Implemented half-heartedly.
But after the brutality in Nirbhaya, there was a great concern raised before the authorities to implement such a law that not only deals with juveniles in conflict with laws in a better way but also provides care and protection to delinquent juveniles. In all the cases, a person becomes delinquent when society deals with it strangely. When a juvenile sees great inequalities in society, his mind responds to the same in a bad way.
