Trust is a fragile feeling, it becomes rock solid & turns into a firm belief in the truth of something when we have confidence. It is not easy to build up trust in anything it can take ages. Our Legal system since as ages has been dwelling on a weak reputation. Legal system of Our Country including the Indian Constitution, the Parliament, three organs the institutions that enforces law, the police & the civil servants. The honor of all of them is in a very delicate spot as the trust of the public is fragile.
The legal system of our country has been working with the sole objective of providing justice to the aggraded in the light of equity, justice & good conscience
The legal system suffers from drawbacks it is impossible to have institution free from flaws. It is accepted that there are a few critical concerns in the justice system. But the achievements of the working, where justice has been rendered & the wrong have been punished. We must hold high regard of the landmark judgments of the Bench which they have changed the structure of the society.
Since Independence, the legal system especially the judiciary has played a vital role as the guardian of the Constitution, it has played a critical sole in strengthen human rights & uphold rule of law. But the mishappenings have been in view, instead of appreciating and praising the works of the advocates and the judges, the loopholes & the problems have always been pictured & broadcasted, especially outlook of the public at large towards our pendency of cases.
This critical concern & challenge of Burden of Massive backlog of cases is inevitable as India ranks at the second position in terms of Population in the world. The Courts have accepted this problem as a challenge has been working eminently to dispose them at the earliest.
But it is high time that we must also acknowledge the contribution. By Counting the bad eggs we might not be able to do anything better or change our present, but by appreciating and cherishing the good eggs we might get healthy chickens who will lay eggs, double the present bad eggs. Thus was must broadcast and the power our legal system.
Let’s take note of the legal systems which has changed drastically over the period. The Indian judiciary has been working for the welfare of the people. The landmark judgments of Kameshwar Prasad case in the abolition of Zamindari system, the Champakam Dorairajan case for right to education, the innumerable cases for the protection of right to life namely Maneka Gandhi, Justice Pullaswamy Judgements, the S. P. Gupta v. President of India & others- which to commenced an era of judicial activism under Public interest Litigation
The Courts have been growing and developing with times, there are innumerable changes in the Juvenile Justice system, for the protection of minors, and the recognition and provisions for LGBT community in the Bar & the Bench, the Law Colleges have also gone ahead a step further by introducing free legal aid where law students spread legal education in rural areas. The Courts have introduced digital & technological platforms to reduce Court process with E- filing etc. The Alternative Dispute Mechanism is working wonders with the right contribution and support.
The law in India is based on the sources of ancient religions, customs, traditions etc. The Indian law is a complex mechanism as there are different personal laws applicable to different people. It is a time taking process as it involves lives & livelihood of people. We cannot expect instant judgments & decisions because it involves principles of rights of the person, the victims and the accused. There must be a fair & reasonable trail conducted & it cannot be done instantly. Thus takes time. But the people must have trust, faith & belief in the legal systems as the law is protector of the rights of the people, the court is a temple.
